These Terms & Conditions (“Conditions”) apply to all consumer purchases of tiles, mosaics, flooring and related goods (“Goods”) from 888 Sourcing Ltd t/a MegaTiles (“Company”, “we”, “us”, “our”).

Your statutory rights under the Consumer Rights Act 2015 and Consumer Contracts Regulations 2013 remain unaffected.

1. DEFINITIONS & INTERPRETATION

1.1 Definitions
(a) “Goods” means all tiles, mosaics, flooring, underfloor heating and related items supplied by the Company.
(b) “Price” means the total amount payable for the Goods including VAT and any delivery, carriage or insurance costs.
(c) “Consumer” means an individual acting for purposes wholly or mainly outside their business or profession.

1.2 Interpretation
(a) Headings are for convenience only and do not affect interpretation.
(b) References to “writing” include email.
(c) References to statutes include amendments and replacements.

2. GENERAL CONDITIONS

2.1 By placing an order, the Consumer confirms acceptance of these Conditions.
2.2 These Conditions may only be varied in writing by a Company director.
2.3 The Consumer acknowledges receipt of all required pre-contract information on a durable medium.
2.4 Nothing in these Conditions affects statutory rights.

3. PRE-CONTRACT INFORMATION

3.1 Prior to contract formation, the Company provides:
(a) full business and contact details;
(b) a clear description of Goods;
(c) total Price including VAT;
(d) delivery options, timelines and charges;
(e) payment methods;
(f) cancellation rights and limitations;
(g) returns procedure;
(h) Cancellation Procedure (available upon request).

3.2 By placing an order, the Consumer acknowledges receipt of this information.

4. SAMPLES

4.1 Consumers are strongly advised to order samples (4.1).
4.2 Ordering full Goods without sampling is at the Consumer’s risk (4.2).
4.3 Delivery costs for samples are non-refundable.
4.4 Shade, texture and batch variations may occur (4.4).
4.5 Samples represent current batch only (4.5).

5. DESCRIPTION OF GOODS

5.1 All images and descriptions on our website are illustrative only (5.1a).
5.2 They do not form part of the contract (5.1b).
5.3 The Company may correct typographical or clerical errors without liability (5.2).

6. ORDERING GOODS

6.1 The Consumer is responsible for measuring and ordering sufficient quantity (6.1).
6.2 A recommended allowance of 10–15% extra is advised (6.1a).
6.3 Batch/shade matching for subsequent orders cannot be guaranteed (6.2).
6.4 All Goods must be inspected prior to installation; once fixed/laid/applied, no claims will be accepted for shading, variation or visible defects (6.2a).
6.5 The Consumer must check receipt of complete order prior to booking installers (6.3).

7. AVAILABILITY & DELIVERY

7.1 All Goods are subject to availability (7.1).
7.2 Goods in stock are normally dispatched within 1 working day after cleared payment (7.1a).
7.3 Delivery times are estimates only; time is not of the essence (7.1b).
7.4 If supplier delays occur:
(a) Company will notify the Consumer of a revised estimate;
(b) Consumer may cancel unprocessed orders for a refund (7.4b).
7.5 The Company is not liable for financial loss caused by delivery delays (7.5).
7.6 Delivery is curbside only unless otherwise stated (7.6).
7.7 The Consumer must inspect Goods before accepting (7.7).
7.8 Visible damage or shortages must be noted on the delivery note (7.8).
7.9 Failure to inspect before acceptance may void claims (7.9).

8. TITLE & RISK

8.1 Risk passes to the Consumer upon successful delivery/acceptance (8.1).
8.2 Title remains with the Company until full payment is received (8.2).
8.3 Until title passes, the Consumer:
(a) holds Goods as bailee;
(b) must store Goods securely and separately;
(c) must insure Goods appropriately.

9. PRICE & PAYMENT

9.1 Prices include VAT unless otherwise stated (9.1).
9.2 The Company reserves the right to amend Prices due to market changes or VAT changes (9.1a).
9.3 Quotes and brochures do not constitute contractual offers (9.2).
9.4 Payment must be made by approved card or cleared funds (9.4).
9.5 Consumer must provide full, accurate billing information matching card issuer records (9.4a).
9.6 The Company may delay dispatch pending fraud checks or payment verification (9.6).
9.7 The Company may cancel suspected fraudulent orders (9.6a).
9.8 Interest of 5% above NatWest base rate may be charged on overdue sums (9.8).
9.9 All reasonable debt recovery costs are recoverable (9.8a).

10. SPECIAL ORDER / CUSTOM GOODS

10.1 Full payment is required prior to confirmation (10.1).
10.2 Lead times will be advised; may vary by ±1 week (10.2).
10.3 Goods used in untraditional applications must be declared at purchase (10.3).
10.4 The Company accepts no responsibility for suitability where not disclosed (10.4).
10.5 Special/custom orders are non-returnable and non-cancellable (10.5).

11. CONSUMER CANCELLATION RIGHTS

Statutory Cooling-Off Rights
11.1 Consumers may cancel standard stock orders within 14 days of receiving Goods (11.1).
11.2 Exclusions apply to special/custom orders (11.2).
11.3 If cancelled under statute:
(a) Consumer must return Goods at their own cost;
(b) Goods must be unused, in resaleable condition and in original packaging;
(c) Refund includes item price + basic delivery cost;
(d) Refund issued within 14 days of Goods’ return/return proof.

12. CHANGE-OF-MIND RETURNS (COMMERCIAL POLICY)

12.1 In addition to statutory rights, the Company offers a 30-day returns window for standard stock Goods (12.1).
12.2 A 25% restocking/admin fee applies to change-of-mind returns (12.2).
12.3 Delivery charges are non-refundable (12.3).
12.4 Return carriage is the Consumer’s responsibility (12.4).
12.5 Credit/refund processed within 7 working days after inspection (12.5).
12.6 No returns on:
(a) special/custom orders;
(b) clearance or sale items;
(c) job-lot bulk purchases (12.6).

13. DAMAGE, SHORTAGES & CLAIMS

13.1 Claims for damage or shortages must be made in writing within 3 working days (13.1).
13.2 Goods must not be accepted/signed for if visibly damaged (13.2).
13.3 Damaged Goods must be returned to the Company for inspection (13.3).
13.4 If damage occurred in transit:
(a) Company will replace the Goods; or
(b) provide refund if stock is unavailable (13.4).
13.5 No claims will be accepted after Goods are installed (13.5).

14. LIABILITY & WARRANTY

14.1 Nothing excludes liability for:
(a) death or personal injury caused by negligence;
(b) fraud or fraudulent misrepresentation;
(c) liabilities that cannot be excluded under the Consumer Rights Act 2015 (14.1).

14.2 Subject to 14.1, the Company:
(a) limits liability to the Price paid for the Goods;
(b) excludes all indirect or consequential losses including loss of profit;
(c) makes no guarantee as to suitability unless expressly stated in writing;
(d) relies on the manufacturer’s warranty where applicable.

14.3 No tiles are guaranteed against crazing (14.3).
14.4 Shading variation is an inherent characteristic (14.4).

15. CLEANING, CARE & MAINTENANCE

15.1 The Consumer must follow manufacturer guidance - Please refer to our the ‘Aftercare & Maintenance’ section of our website (15.1).
15.2 Chemicals, sealers and detergents must be patch-tested (15.2).
15.3 The Company is not liable for damage caused by improper cleaning or chemical use (15.3).

16. VAT EXEMPTION (DISABILITY)

16.1 VAT exemption requires:
(a) HMRC declaration;
(b) schedule of works from VAT-registered builder;
(c) any other evidence required under UK VAT rules (16.1).

17. DATA PROTECTION

17.1 Personal data is processed in accordance with our Privacy Policy and UK GDPR (17.1).
17.2 The Consumer acknowledges the Privacy Policy at checkout (17.2).

18. FORCE MAJEURE

18.1 The Company is not liable for delays or failure caused by events outside our reasonable control including strikes, accidents, transport issues, supply problems, or natural events (18.1).

19. GOVERNING LAW & JURISDICTION

19.1 These Conditions are governed by the law of England & Wales (19.1).
19.2 Courts of England & Wales have non-exclusive jurisdiction (19.2).

20. SEVERABILITY

20.1 If any clause is found invalid, the remainder continues in force (20.1).

21. ENTIRE AGREEMENT

21.1 These Conditions and any order confirmation form the entire agreement (21.1).
